KOHIKO ART LLC (the "Company") sets out in these Terms of Use (the "Terms") the conditions for using the website "kohikoart.com" (the "Site") operated by the Company. Anyone using the Site (a "User") is deemed to have agreed to these Terms.
These Terms apply to all matters relating to the use of the Site between Users and the Company. The Company may establish separate rules regarding the use of the Site in addition to these Terms. If these Terms and any separate rules differ, the separate rules shall prevail unless otherwise specified.
Users shall prepare, at their own expense and responsibility, the devices, software, and communication environment necessary to use the Site.
The Company appropriately handles Users' personal information obtained through the operation of the Site in accordance with its separately established Privacy Policy.
Copyright in images of paintings, text, and all other content on the Site belongs to the Company or the rightful owners. Users may not reproduce, republish, transmit, transfer, or make secondary use of such content without the Company's permission beyond the scope of private use. Any other act that infringes the Company's intellectual property rights, including trademark, design, and copyright, is prohibited.
Users shall not engage in the following acts when using the Site:
(1) Acts that violate, or may violate, laws and regulations
(2) Acts contrary to, or that may be contrary to, public order and morals
(3) Acts that cause, or may cause, damage to the Company or third parties
(4) Acts that infringe, or may infringe, the rights of the Company or third parties
(5) Impersonating others or submitting false information
(6) Acts that interfere with the operation of the Site
(7) Any other acts the Company deems inappropriate
(1) Users represent and warrant that they are not organized crime groups, members of organized crime groups, companies affiliated with organized crime groups, corporate racketeers, or other equivalent antisocial forces ("Antisocial Forces"), and that they have no socially reprehensible relationship with Antisocial Forces.
(2) If a User is found to have violated the preceding paragraph, the Company may, without prior notice, suspend the User's use of the Site or take other necessary measures. The Company shall bear no responsibility for any resulting damage to the User.
(1) The Company carefully prepares and manages the content on the Site, but makes no guarantee of its accuracy, completeness, or safety.
(2) The Company may suspend or discontinue operation of the Site without notice.
(3) The Company may add to, change, or delete the content of the Site without notice.
(4) The Company shall not be liable for any damage to Users or third parties arising from (2) or (3) above.
(5) The Company shall not be liable for any damage arising from a User's use of, or inability to use, the Site, except in cases of intent or gross negligence on the part of the Company.
(6) The Company is not responsible for the content of external sites linked from the Site, including the online shop.
The Site introduces the works of KOHIKO ART LLC and its partner artist KOHIKO (光日子).
The works include reproductions (editions) that can be purchased online, one-of-a-kind commissioned works shown for reference only, and works to be presented and sold at solo exhibitions and shows. For works and goods available online, the terms of purchase, prices, shipping, returns, and other transaction conditions, as well as the disclosures required under the Act on Specified Commercial Transactions, are those posted on the online shop separately operated by the Company (https://kohikoart.base.shop/).
One-of-a-kind works and works planned for solo exhibitions are shown on the Site only as examples and introductions, and are not sold on the Site.
If a User violates these Terms, the Company may suspend the User's use of the Site or take other measures. The Company may also claim compensation for any damage caused to the Company by such violation.
These Terms shall be governed by and construed in accordance with the laws of Japan. Any dispute between the Company and a User regarding the Site shall be subject to the exclusive jurisdiction, in the first instance, of the court having jurisdiction over the location of the Company's head office.
The Company may revise these Terms as necessary. If a User begins or continues to use the Site after a revision, the User is deemed to have agreed to the revised Terms.
